Spot the (legal) difference

Senior council official Ian Finlay downloads more than 600 indecent images of children and does not go to jail. A school minibus driver, Norman Hersey, downloads 100 and is (rightly) sent down.
The difference seems to be that the cases were presided over by different judges. For the criminal justice system to work properly, there has to be consistency and in these two cases there is a clear lack of that. Judge Roger Jarvis said exactly what everyone wants to hear when jailing Hersey.
Judge Wiggs in Finlay’s case, was clearly very wide of the mark.
