Stay of execution on cards for popular cafe

A POPULAR Christchurch restaurant threatened with closure could be given a stay of execution nearly four months after Dorset County Council appeared to seal its fate.

Plans to extend Christchurch library into neighbouring Kelly's Kitchen were given the go-ahead in a split vote by the county council's planning committee in March, despite objections by Christchurch Borough Council and residents.

But now the family-run restaurant could be saved. The restaurant's solicitor, Lionel Fynn, said Dorset County Council had agreed to throw out the planning consent after it was presented with details of the legal case the couple would be proceeding with.

Mr Fynn of Bournemouth law firm Horsey Lightly Fynn said: "It hasn't happened yet but if it all goes ahead then Mr Kelly's case will have to be made afresh. Hopefully all of Christchurch will come to Mr Kelly's support."

Terry Kelly, who has run the restaurant since 1993, said: "We are very pleased and hope that when they look at this again they will submit a fresh application and not the same one.

"We want them to listen to the people of Christchurch, the borough council and the Chamber of Trade. More than 11,000 people signed our petition - which is nearly a quarter of the population of Christchurch.

"We've been left hanging since 2003 when this all started. Hopefully now we can get a conclusion."

Susan Zeiss, principal solicitor at Dorset County Council, said: "Recent planning cases in the UK courts have set new guidance on the way the legislation governing the drafting of planning notices should be followed once a decision has been reached. As a result, while the permission for Christchurch Library remains in place, due to the particular circumstances of this case officers are reviewing the permission."

And Paul Leivers, head of cultural services at the council, said: "This is an important planning application to improve the delivery of the library service for people in Christchurch and to avoid many months of delay with court proceedings and cost, we would be willing to resubmit the application if necessary."

Reply I should darn well think so too. This Cafe 'Kelly's Kitchen' is in an a very strategic position for all those who wish to have refreshments whilst waiting for a Bus.

From a window seat you can see when your Bus arrives and in comfort, whereas in Winter it also acts to shelter the traveller from our awful cold, wet, and windy climate as is too often the case.

Those persons who say this Cafe must close to give space to the Library are not giving this subject any due consideration as to how it will effect the Town and its popularity.

There is also the fact that nearby there is a huge area of Scrub Land growing weeds about six feet tall why are the Councils allowing this area to go to waste when space is so valuable?

As usual, a Tory run Council with little to no Management Skills gain.

God help us all if the Tories get back in Power.

The unhygienic practices observed in this cafe persuade me that the sooner this place is closed the better.

That proves that over three quarters of christchurch couldn't care less about the place,I have lived here all my life and not been in there once..shut it down and fill the place with books !

Reply I said, "God help us all if the Tories get back in Power" did I Not?

By saying this, I am referring to the way The Tories wrecked our countries economics whilst last in Power.

One of the key reasons Thatcher failed was because she changed the laws relating to companies having to reinvest with thier Huge Profits back into the Countries economy.

She allowed the Profit to flow out of this country and create a vast void in the countries economic structure.

Millions of companies all appeared to collapse bringing about 'Mass Unemployment on a grand scale'.

When in fact most were investing thier vast profits overseas.

We all know just how Brown manipulated finances to maintain his so called Prudence Structure. So consequently you can only Rob Peter to Pay Paul until Peter has no money to take, that is just about, where we are now.

If it were as bad as you say, then why have more than 11,000 people signed our petition - which is nearly a quarter of the population of Christchurch?

There are photos of both Kelley's Kitchen and Baggies in 'Dorset Visual Guide which also shows the alleyway leading to the large area of open unused scrub land area between the two Cafe's

One cannot fail to see that both Cafes are bursting with customers so much that tables and chairs are on the pavement to accommodate the vast customer demand .

I don't know what all the fuss is about, as I have said before they could always relocated the cafe...an extended library is the way forward..

Reply Why can't you read digest and understand what other posters have posted bobble212 Are you not of English Nationality?

As I said before:

This Cafe 'Kelly's Kitchen' is in an a very strategic position for all those who wish to have refreshments whilst waiting for a Bus.

From a window seat you can see when your Bus arrives and in comfort, whereas in Winter it also acts to shelter the traveller from our awful cold, wet, and windy climate as is too often the case.

Hence relocation is out of the question on these points mentioned.

we need a bigger library NOT but then i forgot christchurch is a town going backwards not forwards thats why so many shops are moving out of the town should we dig up the tarmac roads and replace them with good old cobble stone and have water butts for our horses to take refreshment???

Reply I went into this library this monday, and there were about three people looking for books, about four people using PC Terminals that's all there were.

I went and used a PC terminal, and after signing in with the complex security system they have and eventually accessing one of my e-mail accounts

I had to call the assistant over to explain as to why I could not open my E-amail due mainly to thier stupid High Security.

I then had a Warning Sign say YOU Have just ten minutes of FREE time left then it's One pound for every half hour after this.

So not only to we the Rate Payers pay for this system we have a Douible TAX so to spealk, by charging us extra for using PC's given FREE from Lottery Money.

They the library want to turn the library into another TAX Cow for UK Gov.

that is out of order...the reason people don't use the library is because it does not have enough room to hold extra facilities to engage more people...the greatest gift you can give a child is a book...look what J.K.Rowling did to countless children. How many people that go into the cafe are waiting for a bus...waiting for God more like..

I see, that the reading of books hasn't done you much good has it? For otherwise you would have greater intellect and more understanding of the World around you.

You should also be able to read and digest that which you read, otherwise a Library Full of Books is useless you.

You need to take your head out of the books (so to speak) and join the real World.

Ah, so everybody who disagrees with you is talking rot. Idiot. I saw a member of staff of Kelly's Kitchen visit the toilet....she could not POSSIBLY have washed her hands in the time taken. This is just one example of the poor hygiene practised in this 'greasy spoon'. Close it down, I say.

Reply If what you say was FACT, and not a made up story. It was your Civic Duty to report this matter at that moment in time, if indeed it were true at all?

Your actions, if indeed true were GUTLESS not to report this alleged non event.

You really are a silly sausage (priced very reasonably with egg and chips). How on earth do you know what she was doing in the toilet? Making a general hygeine inspection? Checking her make-up? Hiding from the man with the stopwatch? POSSIBLY!!
