Drunk crash driver "should have got ten years"


A DRUNK driver who walked off after causing “catastrophic injuries” to a motorcyclist and leaving passers-by to come to his aid has been jailed for three and a half years.

David Whittaker was already banned from the road when he got behind the wheel of his works van on October 23 last year, having drunk “a couple of pints of beer” at his local pub and downing double vodkas in his caravan.

LET’S get my stance straight from the start here and state that David Whittaker is drunken scum.

Bournemouth Crown Court heard how Whittaker, 39, who lived and worked at Parkdean holiday park in Sandford, had been “angry” after phone calls with his partner concerning the break-up of their relationship.

Whittaker admitted causing father-of-three Sam Fairbrother grievous bodily harm, two counts of driving while disqualified, two counts of aggravated vehicle taking and driving with excess alcohol.

He also pleaded guilty to having no insurance, failing to stop and failing to report the accident.

Prosecutor Stuart Ellacott said tragedy had struck after Whittaker used a works vehicle for the second time in an hour.

Mr Fairbrother, 36, was on his way home from work to his family in Chalbury near Horton when the crash happened at Sandford.

“He was aware of lights coming towards him on his side of the road. He went to pull out and as he got closer the vehicle suddenly turned to face him,” said Mr Ellacott.

“The van sped up, Mr Fairbrother tried to get out of the way but he couldn’t and there was a huge collision. He was thrown through the air and hit the ground face-down.”

As witnesses rushed to tend to Mr Fairbrother, Whittaker walked away, hailing a taxi and telling the driver: “My mate was knocked off his bike and he’s a goner.”

Whittaker was arrested nearby and found to be nearly twice the legal drink-drive alcohol limit. He denied being responsible for the crash until January 27 this year.

Mr Ellacott said Mr Fairbrother had suffered “catastrophic injuries” which had left him a paraplegic and in hospital for seven-and-a-half months.

Defending Whittaker, James Newton-Price said: “He holds his hands up and accepts he is responsible for causing extremely serious injuries to Mr Fairbrother. He has had an alcohol problem for some 20 years.”

He told the court Whittaker was “depressed by his failing relationship”, adding: “Any apology from him is no consolation to the victim or his family.”

Sentencing Whittaker, Judge Samuel Wiggs told him: “You devastated the life not only of Mr Fairbrother but of his wife and three young children. You were angry that night – the person who felt the brunt of all that was Mr Fairbrother.

“It is almost impossible to imagine worse injuries in somebody who survives.”

Whittaker was banned from driving for six years.

Yet again the justice system lets us down.

This man has no respect for the law or for other people and the sentence should reflect this.

Its disgraceful and the judge should be ashamed to have handed down such a piffling sentence.

I hope it is referred to higher authority and increased.

i have no doubt that when David Whittaker is released from prison in a couple of years he will carry on where he left off,drink driving,driving while disqualified,the poor man he left for dead has a life sentence,so David Whittaker should too,3 and a half years shows the joke of the British justice system,you comite crime and you dont pay for it.

LET’S get my stance straight from the start here and state that David Whittaker is drunken scum.I am a little surprised the sentence is as long as it is when you consider the longest sentence handed down to Ralph Millward's killers was four years and nine months.

In War & Peace, Tolstoi wrote one passage about the differences between nations, using stabbing someone as an example.

The Frenchman would respond one way, a Russian another, etcetera. But in all cases they'd be saying why they had done it.

The Englishman however was different, his response, in Tolstoy's example was "what knife?"

It's amazing how true it is unfortunately.

The Chilcot enquiry happening now, is about why we went to war in Iraq. Eveyone knows we shouldn't have and everyone is denying it.

In todays Echo, there is a story about a man who broke the speeding law and got a ticket...
...not his fault.

David Whittaker destroys one mans life and doesn't admit he was responsible for months.

An overhaul of the criminal justice system and sentencing guidelines in line with public expectations is required here in the UK.
Just don't hold your breath.
Prepare for more outrageously lenient sentences over the next few years as the govt tries to lower the prison population, we've already had Ken Clarke going on about how prisons don't work...

Change the law and maybe we will see less of this ludicrous scenario. Too many people drive when they shouldn't - mobile users, drunken drivers blah blah blah. I watched a male driver drive negotiating a roundabout with his mobile phone upagainst his ear and his head bent sideways! How dangerous is that? I wish there was a way in which we could report every driver who is seen using their mobile phone. There were 3 yesterday in the space of less than a mile in the Southampton area yesterday. How do these drivers get away with it when any of the vehicles who pass them could be a police person in an unmarked police car? The laws in this country are pathetic to say the least

You can, take the plate and report him to the police. If others do the same, maybe something will be done.. in the same way that Section 59's are handed out like flyers to younger drivers.

It is sickening that drivers who cause death or serious injury are still being allowed to get away with pathetic sentences like this man has.

My cousin was killed 13 years ago by a driver high on drugs and alcohol. He was 12 years old. The driver got 8 years and was out in 4. How is this fair?

It never ceases to amaze me that criminal get time off for "good behavior" they should do the full term and if they play up in prison ADD years to their original sentence,surely this is an incentive to behave and least these scum do the full term,why cant those in the judicial system see the sense in this

code word "them-shot" well thats another story and a good way to reduce the prison population

Drunk drivers should perhaps be treated as if they were in Bulgaria, that is hung for the first offence, or El Salvador where they are shot for the first offence. It should be noted that these punishments are imposed even although no accident, injury or death has resulted from the convicted's actions. Drunk driving offences are extremely rare and there is never ever a repeat offender!!

This case serves to illustrate the current complete impotency within the UK judicial system. The person responsible for the collision was twice over the drink-drive limit, and was driving while banned. He should be banned for LIFE, not three and a half years.

Sonjaj, changing the law will have nothing to do with it. This character couldnt keep this one, so changing it will make no difference. The judge needs looking at here, and throwing out as soon as possible. The guy was banned anyway, and depriving someone of walking should carry more than the silly sentence this stupid fool of a judge gave to this sad alcoholic. Its down to the judge being bloody pathetic. Probably has a drink problem too. Chuck him out - he wasnt put there to act like a ****.

Unbelievable. I feel so much for what this family has had to go through because of the actions of some good for nothing waste of space and what his actions have caused.
Whittaker, you are a no good lowlife that does not deserve such leniencyand still have your health when you have all but taken someone elses away.
